This Privacy policy (“Policy”) describes how we process your personal data at KargoWatch. It applies to your use of all KargoWatch services as a user, both free or paid options, including on any and all devices, the infrastructure required to provide our services, and any connections of your account with another application (collectively, the “Services”). From time to time, we may develop new or offer additional services. They will also be subject to this Policy, unless explicitly stated otherwise.

Many privacy laws give rights to individuals over their personal data. Some rights only apply when KargoWatch uses a certain 'legal basis' to process your data. You can do this if your personal data is inaccurate, our processing is unlawful, we do not need your information for a specific purpose, or you object to our processing and we are assessing your objection request. You can request that we stop this processing temporarily or permanently. You can exercise your right to restriction by contacting us.
Object to us processing your personal data.
You can do this if KargoWatch is processing your personal data on the legal basis of legitimate interests or for tailored advertising. To exercise your right to object, you can contact us.
Request a copy of your personal data in electronic format and the right to transmit that personal data for use in another party’s service.

KargoWatch does not carry out this type of automated decision making in the Services.

3. Personal data we collect about you
Collected when you sign up for the Services or when you update your account:
User Data
Personal data that we need to create your account and that enables you to use the KargoWatch Services.
The type of data collected and used depends on the type of Services. It also depends on how you create your account, the country you are in, and if you use third party services to sign in. This may include your profile name, email address, password, phone number, date of birth, gender, street address, country, or age. We receive some of this data from you during the sign up, and we may also collect some of this data from your device e.g. country or region.
Street Address Data
We may ask for and process your street address to check eligibility for the Services, to deliver notices which are required by law, to deliver support options, or for billing and tax administration. In some cases, we may use a third party application to help you verify your address.

Personal data collected and processed about you when you’re accessing or using the KargoWatch Services. There are a few types of information this includes, such as:
(a) Information about how you use the Services
Examples include information about your Services options, your actions with the Services (such as search queries and history), content you provide when using any part of the Services.

Examples include your URL information, online identifiers such as cookie data or IP addresses, and information about the devices you use (such as network connection type, provider, browser type, language, operating system, etc.).
(c) Your general (non-precise) location
Your general location includes country, region or state. We may learn this from technical data (e.g. your IP address, language setting of your device) or payment currency.

Payment and Purchase Data
If you make any purchases from KargoWatch or sign up for paid Services or a free trial, we will need to process your payment data. The exact personal data collected and used will vary depending on the payment method and may include name, date of birth, payment method type (e.g. credit or debit card, the card type, expiration date, and card number), postal code, and details of your purchase and payment history.
We may receive some of the data mentioned above from third parties, such as authentication partners, technical services, and payment partners or merchants.
4. Our purpose for using your personal data

Performance of a Contract: When it's necessary for KargoWatch (or a third party) to process your personal data to comply with obligations under a contract with you. This includes obligations under the Terms of Use to provide the KargoWatch Services to you, or to verify information before a new contract with you begins.
Legitimate Interest: When KargoWatch or a third party has an interest in using your personal data in a certain way, which is necessary and justified considering any possible risks to you and other users. For example, using your Usage Data to improve the Services for all users.

Compliance with Legal Obligations: When KargoWatch must process your personal data to comply with applicable laws.

To provide further parts of the KargoWatch Services.

To evaluate and develop new features, technologies, and improvements to the Services. This includes development and training of algorithmic and machine learning models, which help us to enhance our users’ experience.

Reason for sharing: So they can process your payments, and for anti-fraud purposes.
Marketing Partners: User Data, Usage Data
Reason for sharing: To promote KargoWatch with our partners to enable you to participate in promotions or bundled offers. Our partners may also combine the personal data we share with them with other data they collect about you, e.g. your use of their services. We and our partners may use this information to present you with offers, promotions, or other marketing that we think you may find relevant.
Law enforcement and other authorities, or other parties to litigation: User Data, Street Address Data, Usage Data, Payment and Purchase Data
Reason for sharing: When we believe in good faith it’s necessary for us to do so to comply with a legal obligation or respond to a valid legal process (such as a search warrant, court order, or subpoena), or for our own or a third party’s justifiable interest.
Purchasers of our business: User Data, Street Address Data, Usage Data, Payment and Purchase Data
Reason for sharing: If we were to sell or negotiate to sell our business to a buyer or possible buyer. In this case, we may transfer your personal data to a successor or affiliate as part of that transaction.
6. Data retention
We keep your personal data only as long as necessary to provide you with the KargoWatch Services and for legitimate and essential business purposes, such as maintaining the performance of the Services, making data-driven business decisions about new features and offerings, complying with our legal obligations, and resolving disputes. Some of the categories of retention periods include:
Data retained until you remove it
It is your right to request that we delete certain of your personal data. See the section on ‘Erasure’ in Section 2 above for more information. Where users are able to see and update the personal data themselves, we keep the information for as long as the user chooses unless one of the limited purposes described below applies.Data that expires after a specific period of time

We keep some data until your account is deleted. Examples of this include your username and profile information. We also typically keep your search history for the life of an account. After your account is deleted, we may keep some data for a longer time period but for very limited purposes. For example, we may be subject to legal or contractual obligations that require this. These may include mandatory data retention laws, government orders to preserve data relevant to an investigation, or data kept for the purposes of litigation. On the other hand, we will remove unlawful content if the law requires us to do so.
7. Transfer to other countries
Because of the global nature of our business, KargoWatch may share personal data internationally with subcontractors, partners or third party providers in order to provide the Services to you. They may process your data in countries whose data protection laws are different from the laws which apply where you live. Whenever we transfer personal data internationally, we make sure the data transfer complies with applicable law.
8. Keeping your personal data safe
We are committed to protecting our users' personal data. We put in place appropriate technical and organisational measures to help protect the security of your personal data. However, be aware that no system is ever completely secure. We have put various safeguards in place to guard against unauthorised access and unnecessary retention of personal data in our systems. To protect your user account, we encourage you to use a strong password which you only use for your KargoWatch account, never share your password with anyone, limit unauthorized access to your computer and browser, and log out once you have finished using the Services on a shared device. If others have access to your account, then they can access your personal data, controls and the Services available in your account. It is your responsibility to only allow individuals to use your account where you are comfortable sharing this personal data with them.
9. Children
The KargoWatch Services are not directed to children under the age of 13 years, or whose age makes it illegal to process their personal data or requires parental consent to process their personal data. We do not knowingly collect or use personal data from children under the applicable age limit. If you're under the age limit, do not use the KargoWatch Services, and do not provide any personal data to us. If you are a parent of a child under the age limit and become aware that your child has provided personal data to us, please contact us. If we learn that we have collected the personal data of a child under the applicable age limit, we will take reasonable steps to delete the personal data. This may require us to delete the account for that child.
10. Changes to this Policy
We may occasionally make changes to this Policy. When we make material changes to this Policy, we will provide you with notice as appropriate under the circumstances.
